General conditions related to Training360 Kft’s training courses and guarantees

Implementation of the training courses

The training courses will be held at the site of Training360 Kft. (South Buda Business Park, 1117 Budapest, Budafoki út 56., A épület). The hardware, the software and the educational conditions required for the courses will be provided by Training360 Kft. The courses will be held in an intensive regime, at a daily rate of 8 to 10 classes, between 9 AM and approximately 5 PM. In the case of courses held in a different medium, such as online training, the participants and the customer will be informed about the details of the training separately. If requested, we will recommend suitable accommodation in the vicinity of our training centre for participants arriving from the countryside. However, Training360 Ltd. has no legal relationship with these accommodations, and therefore fully disclaims any responsibility for the accommodation services.

Application

Applications to training courses must be made via application forms sent to the address of Training360 Kft. (1117 Budapest, Budafoki út 56., A épület) via regular post or e-mail (info@training360.com, in a scanned copy) no later than 2 weeks before the starting date of the training course at issue. Also, applicants can register to our training courses online at the website of Training360 Kft. (www.training360.com). If the training course is started with open places still available, we accept applications even beyond the two-week limit.

Courses can be ordered by an official, individual or company order as well, under the course conditions set out here or in a separate contract. By submitting the application form, the order or the online application, the customer/participant accepts the general course and guarantee conditions as binding on itself. In case of other conditions specified by the customer/participant and not regulated in the contract, the present conditions of Training360 Kft. shall apply.

If course vouchers are used, the customer is obliged to indicate the identification number and expiry date of the vouchers in writing to Training360 Kft. at the time of application (before the start of the course).

Implementation of the training courses

Depending on the type of the training course, at least 4 to 6 applications are required for starting the announced courses. If too many applications are received, additional courses will be held, the dates of which will be communicated to the participants. Participants will be informed about the acceptance of their application and other details relating to the course in a written confirmation sent by e-mail or post. If the number of participants required for starting the course is not met or the date is changed by Training360 Kft. for any reason, participants will be informed in writing 5-10 days before the start of the course. We shall conclude an adult education contract with the participants before the course or on the first day of the course, at the latest. Under Act LXXVII of 2013 on Adult Education, the customer/participant is required to submit the list of participants to Training360 Kft. in writing no later than 5 working days before the start of the training course. An attendance sheet and a progress log will be maintained throughout the entire duration of the course. With the exception of certain supported and authorised courses, our training courses are not subject to exams. At the end of training courses, certificates will be issued centrally. In the case of notifiable training courses, participants are required to declare, at the latest at the time of contract conclusion, whether they request the issuance of the Certificate or not (in the case of authorised training courses, certificates are issued automatically when the course is completed). Training courses end with an oral and/or written evaluation (pass/fail). It should be noted that different rules may apply to the completion of non-classroom courses. After certain courses, such as Microsoft, Cisco, VMware, ITIL® or PRINCE2®, optional formal exams can be taken at our official Pearson VUE or PeopleCert® exam centres, offering internationally recognised certifications. With the exception of discounted or individual packages, where the matter is specifically indicated, exam fees are not included in the course fees. Exams are conducted on the basis of a separately documented system of conditions, about which the participants are informed upon request.

Course fees & payment and cancellation policies

The full fee for the course or related training service (or, in case of payment in installments, the amount of the installment) can be paid in cash, card or, for companies, by bank transfer to our account or proforma invoice/advance account with an 8-day payment deadline. If preliminary knowledge assessment is requested, the related fee will be invoiced separately before the start of the course, regardless of the eventual participation in the course. In case of individual payment requests or conditions, the written permission of Training360 Kft. and/or a valid contract is required. Our customers and participants will be informed about the terms of payment in our confirmation letter, and these terms will be posted to our website as well. The invoice will be sent via email in PDF format within 8 days of completion. The customer is required to ensure that emails from the training360.com domain are received in the customer's email system to guarantee the arrival of the invoice. For any payment requests or terms differing from this, written approval from Training360 Ltd. and/or a valid contract is required. If the invoice or proforma invoice/advance invoice is not paid by deadline, we will charge twice the current central bank base rate as default interest. Our products may include subcontracted services, which will be indicated on the invoice in such cases.

Participation in training courses can be cancelled only in writing and before the start of the course. Participation can be cancelled or rescheduled free of charge up until 10 working days before the start of the course. If the applicant indicates his or her intention to withdraw between 10 and 6 working days before the start of the course, we will charge 50% of the list price of the course. If withdrawal occurs within 5 working days before the start of the course, we will charge 75% of the list price. If the applicant fails to show up at the course without any written feedback, we will charge the full list price of the course to the party who officially ordered the training course.

Participation in the training course can be transferred to other individuals only if the client indicates its intention to do so in writing no later than 2 working days before the start of the course and if the electronic study materials, if any, have not yet been accessed and activated. If the electronic study materials are accessed and activated, participation cannot be transferred and the course fee will be charged in full to the new participant.

Important note As of 24 February 2020, the cancellation policy for official Cisco training courses has changed. Free cancellation of participation can only be requested in writing no later than 35 working days before the start of the training, by e-mail sent to info@training360.com or in person at the competent training coordinator of Training360 Kft. who confirmed or acknowledged the order. If the cancellation request is received less than 35 days before the start of the training, the following conditions apply. If the training is cancelled between 35 to 11 working days before the start of the training, we will charge a cancellation fee of 50% of the training fee. If the training is cancelled 10 or less working days before the start of the training, the same cancellation fee will be 100% of the training fee.

Cooperation & warranty

The Contracting Parties agree to cooperate in settling all eventual disputes. Training360 Kft. guarantees that all trainings will be held in high quality. In case of any non-compliance, the participant or the customer may lodge a complaint with Training360 Kft., which will be investigated in accordance with the complaint procedure included in the quality management system of Training360 Kft. and, if a legitimate claim exists, compensation will be provided under the warranty conditions of Training360 Kft. (see www.training360.com). In all other disputes, the provisions of the Civil Code apply.

Confidentiality, Data Protection

Training360 Kft. represents and warrants that the information and data submitted during registration will only be used for its own internal tracking and administration purposes and will not be disclosed to any other firm or third party, except where it is required by the relevant laws and regulations, nor will they be used for marketing services unless the applicants have given their express consent thereto during registration. We shall not be held liable for any damage or abuses resulting from the improper handling of the e-mail address and the password by the user.

Under current legislation, Training360 Kft. has an obligation to provide statistical data. Therefore, the submission of additional personal or company data may be required on top of the data provided during the application. Such information must be provided to Training360 Kft. on a statistical data sheet before the start of the training course or, at the latest, when the adult training contract is concluded. Training360 Kft. manages your personal data in accordance with the GDPR, which came into force on 25 May 2018. Copyrights

The reference materials and tools handed over to the participants for use during the training shall remain in the exclusive property of Training360 Kft. and their manufacturer, and cannot be removed from the location of the training. It is forbidden for participants and users to copy any documents or official training materials provided to the participants or loan any such resources to third parties. The conditions of use are determined by Training360 Kft. or the manufacturer, and are indicated in the training materials. The Customer (and all participants) may use the intellectual property made available to them under the contract exclusively for the purposes corresponding to the subject of the contract. The Customer is fully responsible for the individuals they designate to participate in the courses; however, Training360 Ltd. is entitled to take direct action against these participants. The Customer acknowledges and agrees that the intellectual property will be used exclusively in accordance with the terms of use specified by Training360 Ltd. (particularly the provisions of the contract and the General Terms and Conditions). The Customer acknowledges that any violation of these terms may result in legal action by Training360 Ltd. against the Customer. Copying, modifying (or creating derivative works), lending to third parties, or any further authorization, publication, or use of the intellectual property provided by Training360 Ltd. is prohibited for both the Customer and any individuals who have access to the intellectual property (participants).
For online (live virtual classroom / LVC) or in-person, classroom-based courses, any form of audio and/or video recording and use of the training or any part thereof (including, but not limited to, recording, publishing, or other use by the participant and/or customer) is prohibited without the prior written permission and consent of Training360 Ltd. In the event of copyright infringement, the offending party will be fully liable for damages.

Miscellaneous

In the case of certain training courses to which a periodic discount or date guarantee applies, different general, cancellation or payment conditions may apply, even if a framework contract exists. The existence of such special conditions will be indicated in the context of the specific discount offer or training course. Please always read the special conditions for discounted courses. Training360 Kft. reserves the right to partially modify its announced course conditions to ensure conformity with external or internal legal regulations. The applicants and the Customer will be informed about such modifications in advance and in writing. The current conditions and changes as well as the warranty conditions are accessible on the website of Training360 Kft. at www.training360.com/general-terms-and-conditions-for-courses. These general provisions related to the training courses and guarantees may be superseded by provisions included in other separate agreements.

Possible organisational changes

In the event of unforeseeable events, such as the illness of the lecturer or if the provision of services is interrupted due to a power outage, missing internet connection etc., Training360 Kft. reserves the right to cancel the date of the announced training course. Training360 reserves the right to cancel the date of the training if the number of applicants does not reach the required threshold. In such cases, the customer who ordered the training and the registered participants will be informed about the possible new date.

Guarantee

We strive to conduct our training courses at the best uniform standard possible, as advertised and according to the requirements of the client. Still, if you are not satisfied with the training you have received, you have the right to make a complaint and claim adequate compensation.

Often, potential issues related to our training courses can be solved immediately upon receiving prompt feedback. During the course, our participants and customers have the opportunity to report to our instructors, training coordinators or product managers the professional or personal issues or shortcomings that may affect the quality or efficiency of the education. We encourage you to actively make use of this solution, because we will respond to any feedback immediately or as soon as possible.

Upon completion of the training course, the participants will have the opportunity to evaluate the quality of the courses and their implementation by way of questionnaires or an online evaluation system. Also, they are encouraged to express their opinions and suggestions to help improve the quality of future training courses. In case of obvious nonconformities or dissatisfaction, our colleagues will contact you to discuss and settle the issues.

If you are not satisfied with the professional standard of our course, you can terminate your participation at any time and file a written complaint with our colleagues within 5 working days upon course completion, indicating your objections, issues and reasons for filing a complaint. We will examine all complaints within two weeks after reception and settle the issues in the context of personal consultations. As a result:

1. the training can be repeated free of charge on one occasion at the announced additional dates, but no later than six months after the completion of said training, on condition that registration is done in advance (our general course conditions shall continue to apply). The participant is required to bring the aids and materials provided for the training course to the next one. In this case, the additional services provided for the training, such as meals or other benefits, will be discontinued.

2. the training can be switched for another, similarly-priced training held at the announced additional dates, but no later than six months after the completion of the initial training, on condition that registration is done in advance (our general course conditions shall continue to apply). Fees for training aids and other materials issued for the initial course, as well as the fee for the services used until that date must be paid in full.

3. if you do not wish to apply for a different training course, the course fee will be refunded to the customer. Fees for training aids and other materials issued for the course, as well as the fee for the services used until that date must be paid in full.

In the case of individual, customised training schemes, we will act on a case-by-case basis and according to the conditions contained in the contract concluded with the customer.
